INVESTIGATION

An investigation (more generally investigation) indicates - in a general sense - a research carried out in certain areas. The term is used above all in law, to indicate and refer to the activity of the judiciary and the judicial police in the exercise of their investigative functions in the prevention and repression of crime.

There are two types of investigation:

preventive, conducted outside the criminal process for needs other than those connected to the reconstruction of a fact that could be criminal (for example, the processing and analysis of information on a person or a phenomenon to ascertain their potential dangerousness in order to 'anticipate' the commission of crimes), reporting to the judicial authority any findings of criminal facts to be prosecuted that may be discovered;
investigatory, usually conducted by the judicial police, within an investigation relating to a criminal investigation already formalized by the judiciary, in order to reconstruct the criminal act by seeking the truth and evidence that will determine the guilt of the perpetrator of the crime in the context of a criminal trial..
